Recently Queensland passed new laws with a number of important changes that may affect you renters out there.
Rent Bidding:
From July 1st 2009 Landlords and agents must state a fixed price when advertising rental properties.
This means that ambiguous 'rent ranges’ and ‘rent bidding’ for rental properties is not allowed and there are strict penalties in place for anyone advertising a rental property without stating a fixed price.
Provision of Documents and Financial Deposits before Entering a Tenancy
Prospective tenants be given a copy of the full tenancy agreement before any written or financial commitments are made.
Before a tenancy agreement is signed the only money a lessor or agent can ask from a tenant is a key deposit, a holding deposit (which must be refunded if a tenant decides against renting a property), bond or rent payments.
Dispute of significant changes to agreements
Tenants can now dispute significant changes between agreements for the same property. Changes might be excessive rent increases, whether pets are allowed or changes to how many people can live at the property. This applies even when the agent or owner of the property has changed.
Tenants can dispute a significant change in their tenancy agreement by lodging a Dispute Resolution Request with the RTA after signing the new agreement.
Rent Payment Options and Fees
If a landlord or agent wants rent to be paid in a way that is not listed in the Residential Tenancies and Rooming Accommodation Act, such as by rent card, they must give the tenant the option to pay with at least two other ways that are listed in the Act. For example, cash, cheque or direct deposit into the landlord or agent's bank account.
Additionally tenants must also be informed of any extra charges such as a 'joining fee' or a service fee that is not the rent that may be payable by the tenant.
Limits to, and Notice of Rent Increases
Rent increases have effectively been limited to once every six months no matter what type of agreement tenants are on.
Additionally there’s now a requirement for lessors and agents to give tenants 2 months written notice of a rent increase during an agreement.
Entry to Property – Times of Inspection
Landlords and agents must now specify on the Entry Notice Form a 2 hour time period during which they intend to enter the premises by themselves. If the landlord or agent is late the tenant can refuse entry.
Landlords and agents can stay in the property past the end of the 2 hour period to complete the job but they must enter the property within the stated 2 hour period.
This doesn’t apply to entry by others such as tradespeople.
Additionally, landlords and agents can only enter the premises on a Sunday, public holiday or between 6:00pm and 8:00am with the tenant's agreement.
Sale of Property Process / Sale or Re-leasing Inspections
Tenants now have the right to end a tenancy agreement if the tenants’ premises are put up for sale within 2 months of signing the agreement and you were not told at the time you signed the agreement.
For tenants’ privacy, your landlord or agent can only hold an open house or on-site auction with the tenant's agreement. The same applies for open houses where a property is being shown for re-renting. Also, photos for advertising of the property showing tenant possessions can only be used if the tenant agrees.
Changes to Grounds for Entry
If a landlord or agent has asked a tenant to fix a significant breach (such as using the property for an illegal purpose) with a Notice to Remedy Breach, the landlord or agent is allowed to enter within a 2 week period of the expiry of the notice to check that the breach has been fixed.
If the landlord or agent has organised repairs to be done on the property, they are also able to enter the property (after giving the correct notice) to make sure the tradesperson has fixed the problem as requested. If the landlord wishes to enter for either of these reasons, they must still give an Entry Notice to the tenant giving 24 hours notice.
Rooming Accommodation Laws – House Rules
A new Act changes some of the rules for renting rooming accommodation. The Residential Tenancies and Rooming Accommodation Act 2008 combines and updates the existing laws that cover renting a room as your home - whether it is in a boarding house, hostel, off-campus student accommodation, Government-run accommodation or accommodation provided by your employer.
Under the new laws, providers are now able to make two new ‘house rules’, about smoking and guests. This means that smoking may not be allowed in the building, or the provider could ask that all smoking happen in the outdoor areas of the building. Additionally, guests may only be allowed to visit at certain times. Residents are able to dispute house rules if they consider them to be unreasonable.
